Please read this agreement carefully. It contains clauses which impose obligations on you and which limit or exclude our liability to you. During the checkout process you will be asked to confirm your acceptance of these conditions so that your order can be processed.

Currently HomeBots only accept orders from and deliver to customers who are resident in a member state of the European Union. We only ship to the billing address of the cardholder.
4. Acceptance of Agreement
Please read this Agreement carefully before ordering any Products from HomeBots.ie. By clicking “I Accept” during the checkout process and ordering any Products via the Website, you agree to be legally bound by this Agreement and confirm your understanding of it. If you do not accept the Agreement you will not be able to order any Products from this Website. This agreement may be amended without notice and therefore should be reviewed each time an order is to be placed.
5. Customer Identity
By ordering through this Website you agree that:
5.1 You are legally capable of entering into this Agreement and are at least eighteen (18) years old.
5.2 The information you provide for the purpose of ordering Products or services is complete and accurate.
5.3 You are legally and fully entitled to use any credit card or debit card furnished for the purpose of making a purchase and sufficient funds are available on the relevant card to cover the cost of purchases by you.
5.5 You are responsible for all activities that occur under your account and you agree to immediately notify HomeBots of any unauthorised use of your account or breach of security.
5.6 Any breach of these clauses will entitle HomeBots to immediately terminate the Agreement and any Contract by notice to you and without any liability to you.
6. Product Descriptions
6.1 You are solely responsible for using your skill and judgement to choose the Products (and associated specification) which are suitable for your purposes and needs and ensuring that they are compatible with any other products or systems you have.
6.2 The Products supplied are manufactured by third party manufacturers and resold by HomeBots in accordance with the manufacturer’s standard specifications which may be subject to revision by the manufacturers from time to time. HomeBots accordingly reserves the right to supply Products with a different specification to that ordered where the ordered Product is unavailable for whatever reason provided that the supplied Product has equivalent functionality, performance and price to that ordered. If you exercise your right of cancellation in accordance with clause 9.5 in respect of any equivalent Product so supplied, HomeBots will bear the cost of returning the Product.
6.3 HomeBots will supply Products to you subject to, and in accordance with, this Agreement and the relevant Contract. The quantity, specifications and description of the Products will be as set out in the Purchase Confirmation.
6.4 All illustrations, drawings, descriptions, specifications and advertising contained on the Website or distributed by other means (email, newsletters, etc.)are published for the sole purpose of giving an approximate idea of the Products described in them. They do not form part of the Contract.
7. Pricing & Payment
7.1 All prices quoted on the website and email communications are shown in Euro (€) and all payments are taken in Euro (€).
7.2 HomeBots use PayPal for payment processing. You don’t have to have a PayPal account in order to use place an order: PayPal accepts major credit cards such as Visa and MasterCard. Your card details are not entered or stored on the HomeBots.ie website.
7.3 Your card is charged at the time of ordering but your order is not processed until HomeBots has received payment confirmation from the Payment Service Provider.
7.4 The prices for the Products include Irish VAT (currently 23%) but exclude delivery costs, which will be added to the total amount due and payable by you as set out in our shipping costs. The price of any Products, unless an error is subsequently identified, is as quoted in this Website except in cases of obvious error.
7.5 The prices and delivery charges for Products may be increased or decreased without any notice. However, the prices variation will not apply to any Products for which a purchase confirmation has already been issued, except where the change is to correct a pricing error.
7.6 Despite HomeBots best efforts, it is possible that Products listed on the Website may be incorrectly priced on occasion. If a Product’s correct price is different than the price stated on our Website we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.
7.7 HomeBots is under no obligation to provide the Product to you at the incorrect (lower) price, even after it has sent you a Purchase Confirmation, if the pricing error is obvious or could have been reasonably recognised by you as incorrectly priced.
8. Order Process
8.1 All orders are subject to acceptance by HomeBots and Product availability. HomeBots will confirm its acceptance of your order by sending you an e-mail titled “Purchase Confirmation”. A legally binding contract between HomeBots and you (called the “Contract”) will only be formed when we send you the Purchase Confirmation.
8.2 The Contract will relate only to those Products specified in the Purchase Confirmation. HomeBots is not obliged to supply any other Products which may have been part of your order until acceptance of your order in this respect has been confirmed in a separate Purchase Confirmation.
8.3 HomeBots accepts no responsibility and will not be liable in any way to you if the Products ordered are unavailable or if an order is rejected or otherwise not accepted. HomeBots is not obliged to provide an explanation for rejecting or not accepting an order.
8.4 HomeBots currently do not accept orders which exceed €1000 in value including any delivery charges.
8.5 Products ordered by you may be specially ordered from our suppliers. Accordingly, an order or Contract for Products may not be cancelled by you except as expressly provided in this Agreement or, in exceptional cases, with HomeBots prior written consent. Any cancellation request must be made to HomeBots within 24 hours of placing the order online. HomeBots is under no obligation to accept the request.
8.6 Subject to stock availability, HomeBots endeavour to process and dispatch orders within 2 working days of order receipt and payment authorisation.
8.7 Once the Products have been despatched, HomeBots will send a Dispatch Confirmation by email.
8.8 Neither party is liable to the other party for any delay or non-performance of its obligations under a Contract arising from any cause or causes beyond its reasonable control (a “Force Majeure Event”).
9. Cancellation – Consumer Rights
9.1 In accordance with Ireland’s Distance Selling Regulations, products may be returned to HomeBots within 7 working days of receipt as long as the goods are not opened and the packaging remains in an ‘as new’ state. Goods must be returned at your own expense and risk with all original tags attached within fourteen (14) days of your cancellation of the Contract.
9.3 Where a refund is required for a cancelled order, the payment will be made within 30 days of the cancellation to the card which was used for payment. HomeBots is not liable for any exchange rate fluctuations, charges or interest. Failure to return the Products within fourteen (14) days of the cancellation may delay the refund.
9.4 This right of cancellation does not apply if:
(i) the relevant Products were made to your specifications or were clearly personalised or, by reason of their nature, cannot be returned or are liable to deteriorate or expire rapidly; or
(ii) the relevant Products are audio or video recordings, computer software or any other intangible digital product and were unsealed by you;
(iii) the provision of any services to you has commenced at any time before the expiration of the seven day period as a result of actions taken by you; and/or
(iv) you are contracting for or on behalf of a company or other commercial entity.
9.5 If HomeBots has at its discretion supplied an alternative, equivalent Product as provided in clause 6.2, instead of the one ordered by you then you may request a return for replacement or refund within two (2) days of delivery.
9.6 HomeBots reserves the right to refuse a refund in whole or part if the Product returned has, whilst in your possession or control, become unfit for resale or damaged or you have not returned the Product and all relevant packaging included in or with the Product when it was delivered to you.
10.1 Shipping is normally free for orders which are shipped to an address in Ireland except for orders with a value of less than €15 which has a €3 postage fee. Some items may incur a special charge but this will be indicated in the item description if relevant. Shipping charges to other destinations are calculated during the checkout process. Please email us if you have any special shipping needs.
10.2 If due to a stock shortage, the normal dispatch window of two days cannot be met and the revised delivery date is more than 30 days from the date of Purchase Confirmation then you have the option of cancelling the entire order or amending it, resulting in a full or partial refund as appropriate.
10.3 HomeBots normally process and ship each order as a single delivery. In the event of a stock shortage this will delay dispatch until all the products are available. If this delay is expected to be more than seven (7) days then HomeBots will advise you by email of the delay and provide an anticipated ship date based on our supplier lead time. HomeBots may, at its sole discretion split the shipment into two or more deliveries, these separate shipping costs will be borne by HomeBots. If you request a split or separate shipping of items then you may be liable for the extra shipping costs.
10.4 We employ An Post or other third-party courier services to deliver your goods. These delivery times are typically 1-3 days after despatch although the exact transit times or delivery date cannot be guaranteed.
10.5 All address information must be accurate, including the postcode where appropriate, and a contact telephone number provided for the recipient. HomeBots cannot accept responsibility for late or non-delivery if the recipient address and telephone details are insufficient or incorrect.
10.6 Deliveries are typically made during office hours, Monday to Friday. Exact times are outside the control of HomeBots. As some deliveries may require a signature, please make arrangements for someone to be available. You are liable for any additional charges incurred by the courier or HomeBots as a result of any failure to receive the goods during attempted delivery.
10.7 Delivery confirmation supplied by our carrier will be accepted by you as proof of delivery of Products.
10.8 For orders being shipped outside the Republic of Ireland, HomeBots.ie cannot be held responsible for importation duty or any other charges.
10.9 Claims for non-delivery must be made within 10 days of receipt of the Dispatch Confirmation email.
10.10 In the case of apparent transit damage to the outer packaging, bring it to the attention of the courier at the time of delivery and comment on any delivery acceptance form. Please photograph the affected area before opening the package in case a subsequent claim may arise.
10.11 HomeBots should be notified within two (2) days of delivery of any damage, shortages, surpluses or incorrectly shipped goods. Please do not open or use incorrect Products.
10.12 Any liability of HomeBots for non-delivery, or delivery of damaged or incorrect Products is limited, at HomeBots discretion to:
(i) Delivering or replacing the relevant Products within a reasonable time;
(ii) Issuing a refund or credit note against future purchases or a pro rata reduction in price, as appropriate.
10.13 HomeBots cannot be held liable for any consequential loss arising from the non delivery, late delivery, partial or incorrect delivery of Products or Services.
11. Return’s policy
11.1 Any and all returns require the completion of a RMA request; please contact HomeBots to initiate this. You will be advised whether your return has been authorised or declined and given further instructions on returning the product. In certain cases you may be required to contact the manufacturer directly to authorise a return. We will advise you in the event of such a case.
11.2 HomeBots is not responsible in any way whatever for any Product returned by you without a valid RMA Number.
11.3 Dead on Arrival: If a product is faulty on receipt it is generally replaced with a new unit rather than repaired. There may be exceptions to this rule.
11.4 Faulty after use: Products that develop a fault after use are generally repaired rather than replaced. Some manufacturers require that the end user contact them directly regarding faulty products and not the retailer. You will be advised if this is the case during the RMA process and we will provide the manufacturer's contact details.
11.5 Please note any items returned incorrectly as faulty or faulty due to user damage under dead on arrival or warranty terms will incur a €20 handling charge excluding any delivery cost. Please contact HomeBots if you are unsure if your item is faulty.
12. Limitation of Liability
12.1 HomeBots provide products for use in domestic homes or small commercial premises. The products are expected to provide benefits of convenience for users. They are not intended for use where any failure to perform as expected, malfunction or any other type of failure could result in serious damage or loss to property or life.
12.2 While HomeBots may through its website or advertising suggest scenarios or applications for the use of the Products, it is up to you to decide how to actually use them and you accept and assume any risk resulting from their use.
12.3 When using HomeBots products in association with any other device, appliance or system it is your responsibility to ensure that such use will not adversely affect, damage or otherwise harm the Products and the other associated items and will not create a situation that could result in serious damage or loss to property or life.
12.4 To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed the value of the original purchase price of the Product in question.
The Products which HomeBots sell are manufactured by third parties. As such the warranty (or guarantee) offered by HomeBots carry only the warranty (if any) of the relevant third party manufacturer and you are only entitled to the benefit of that warranty to the extent that HomeBots has the power to pass through the benefit of such third party’s warranty to you. In general, unless otherwise specified, the warranty period does not extend beyond twelve (12) months from the date of delivery.
14. Intellectual Property (IP)
Products may include technology and/or software subject to Irish, EU and US export control laws as well as the laws of the country where it is delivered or used which you are required to abide by. Under these laws, Product may not be sold, leased or transferred to restricted end-users or countries. HomeBots reserve the right to reject or cancel any order if it suspects may breach Irish, European, US and/or other applicable export control laws. All material on this website is © copyright of HomeBots or its suppliers and partners and may not be used elsewhere in any form without the express written permission of HomeBots.
15. Data protection
You agree that HomeBots may process any personal data you supply to it in connection with the performance of this Agreement and any Contract as well the maintenance of its relationship with you. HomeBots will only share necessary and relevant information with a third party in connection with the supply of Products ordered by you and the processing of payments. Your data will not be shared with any other party for marketing or other purposes. However, data may be retained even after your account has been closed for a period of up to seven (7) years in accordance with record keeping obligations.
16. WEEE & RoHS
HomeBots is registered with the WEEE Register in compliance with the legal obligations imposed by the WEEE Directive 2002/96/EC and the requirements of the WEEE Regulations 2005 and Battery Regulations 2008. Our registration number is IE 01757WB. We are members of the compliance scheme operated by WEEE Ireland (www.weeeireland.ie ) Any RoHS status information provided is based upon the manufacturer's own data and passed on in good faith, without responsibility or liability.
This Agreement and any matter or dispute concerning or arising out of it or any Contract is exclusively governed by Irish law and is subject to the exclusive jurisdiction of the courts of Ireland. However this clause will not prevent HomeBots from making an application for injunctive relief or enforcement proceedings in any other jurisdiction. The clauses contained within this agreement do not affect your statutory rights.
